PREAMBLE: LEGAL BINDING AND SCOPE
The network of web properties, mobile applications, APIs, and educational portals (collectively, the “YSSE Digital Ecosystem”) is owned and operated by the Youth School for Social Entrepreneurs (YSSE).
These Terms and Conditions constitute a Binding Legal Contract between you (the “User,” “Member,” or “Participant”) and YSSE Global. By interacting with our digital ecosystem, you certify that you have the legal capacity to enter into this agreement. If you are accessing this Site on behalf of an organization, you warrant that you have the authority to bind that entity to these terms. If you do not agree to these terms, you are strictly prohibited from using the Site and must exit immediately.
ARTICLE I: STATUTORY DEFINITIONS AND INTERPRETATION
1.1. Terminology: * “Site” refers to www.ysseglobal.org and all sub-domains.
- “Service” refers to the educational content, forums, pitch competitions, and mentorship programs provided by YSSE.
- “Content” refers to all text, images, video, data, and software code within the ecosystem.
1.2. Headings: The headings used in this agreement are for convenience only and shall not affect the interpretation of the legal clauses.
ARTICLE II: INTELLECTUAL PROPERTY AND BRAND STEWARDSHIP
2.1. Exclusive Ownership: All materials, including but not limited to curriculum designs, social entrepreneurship frameworks, graphics, user interfaces, and source code, are the intellectual property of YSSE Global. These assets are protected under the World Intellectual Property Organization (WIPO) treaties and local copyright laws.
2.2. Trademark Protection: The name “YSSE Global,” the Youth School for Social Entrepreneurs logo, and the “Impact through Innovation” branding are proprietary marks. Unauthorized use of these marks to imply an official partnership, endorsement, or affiliation is a violation of law and will be prosecuted.
2.3. Limited User License: YSSE grants a non-exclusive, non-transferable, and revocable license to access the content for Personal, Non-Commercial Educational Purposes. 2.4. Prohibited Acts: You may not:
- Decompile, reverse engineer, or attempt to extract the source code of the Site.
- Use automated scripts (robots/spiders) to scrape data for commercial databases.
- Remove any copyright, watermark, or proprietary notices from YSSE materials.
- Sell, rent, or sub-license any YSSE Academy materials to third parties.
ARTICLE III: USER ACCOUNTS, SECURITY, AND PARTICIPANT CONDUCT
3.1. Registration Integrity: When creating an account, you must provide accurate, current, and complete information. Fraudulent profiles will be deleted without warning.
3.2. Credential Security: You are solely responsible for maintaining the confidentiality of your password. Any activity performed under your account is your legal responsibility.
3.3. Ethical Conduct Standard: As a mission-driven NGO, YSSE maintains a Zero-Tolerance Policy for conduct that contradicts our values. Prohibited behavior includes:
- Cyber-Bullying: Harassment of other social entrepreneurs or staff.
- Misrepresentation: Falsifying venture data or social impact metrics.
- Seditious Content: Posting materials that incite violence or violate the sovereignty of any nation.
3.4. Monitoring Rights: YSSE Global reserves the right, but not the obligation, to monitor all community areas and remove content that we deem, in our sole discretion, to be harmful or unethical.
ARTICLE IV: FINANCIAL GOVERNANCE AND DONOR PROTECTIONS
4.1. Financial Transparency: YSSE Global operates with the highest level of accountability. All membership fees and donations are audited annually.
4.2. Payment Processing: We utilize PCI-DSS compliant third-party gateways. YSSE does not store sensitive financial data locally.
4.3. Refund and Cancellation Policy: * Membership Fees: Generally non-refundable due to the immediate access provided to digital resources.
- Events/Workshops: Refunds are issued only if the event is cancelled by YSSE Global.
4.4. Anti-Money Laundering (AML): YSSE Global strictly adheres to international AML protocols. We reserve the right to refuse donations from sources that cannot be verified or that conflict with our ethical funding guidelines.
ARTICLE V: CONTENT LIABILITY AND EXTERNAL INTEGRATIONS
5.1. Accuracy of Information: While YSSE Global strives to provide high-quality educational data, the materials are provided “AS IS.” We make no guarantees regarding the success of a business venture based solely on our curriculum.
5.2. Third-Party Links: Our Site contains links to external partners (UN, Corporate Sponsors, NGOs). YSSE is not responsible for the privacy practices, safety, or content of these external entities. 5.3. User-Generated Content: You grant YSSE a perpetual, worldwide, royalty-free license to use any ideas or feedback you post on our forums to improve our social impact services.
ARTICLE VI: INSTITUTIONAL DISCLAIMERS AND LIMITATION OF LIABILITY
6.1. Disclaimer of Warranty: YSSE Global disclaims all warranties, express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose. We do not warrant that the site will be uninterrupted, timely, secure, or error-free.
6.2. Limitation of Damages: In no event shall YSSE Global, its directors, employees, or partners be liable for any indirect, incidental, special, or consequential damages (including loss of profits or data) arising from your use of the site.
6.3. Force Majeure: YSSE Global shall not be liable for any failure to perform its obligations where such failure results from any cause beyond YSSE’s reasonable control, including mechanical, electronic, or communications failure.
ARTICLE VII: INDEMNIFICATION AND LEGAL DEFENSE
7.1. General Indemnity: You agree to indemnify, defend, and hold harmless YSSE Global and its affiliates from any claims, liabilities, damages, and expenses (including legal fees) arising from:
- Your breach of these Terms.
- Your misuse of the Site’s content.
- Any content you post that violates the rights of a third party.
ARTICLE VIII: TERMINATION, GOVERNING LAW, AND DISPUTE RESOLUTION
8.1. Termination: YSSE Global reserves the right to terminate your access to the ecosystem at any time, with or without cause.
8.2. Governing Law: These terms are governed by the laws of the jurisdiction in which YSSE Global is officially registered, without regard to its conflict of law provisions.
8.3. Dispute Resolution: Any dispute arising out of this agreement shall first be addressed through Informal Mediation. If mediation fails, the dispute shall be settled by Binding Arbitration in the city of our headquarters.
8.4. Severability: If any part of these terms is held invalid or unenforceable, the remaining sections shall remain in full force.
ARTICLE IX: ENTIRE AGREEMENT AND UPDATES
These Terms and Conditions, along with the Privacy Policy and Code of Conduct, constitute the entire agreement between you and YSSE Global. No oral explanation or information shall alter the interpretation of these terms.
